Note that Children’s Health Insurance Program (CHIP) and Prenatal Care are not available to undocumented children and pregnant women. Recent court rulings have blocked DACA recipients from subsidized ACA plans.


Emergency Medical Care

Hospitals must provide emergency treatment under the Emergency Medical Treatment and Labor Act (EMTALA), and South Dakota offers reimbursement for specific emergency services for non-citizens that are low income


State-Funded Prenatal Care

South Dakota uses state funds (and sometimes CHIP funds) to cover prenatal care for those with low incomes, regardless of immigration status, ensuring coverage for labor and delivery. All individuals, regardless of immigration status, are eligible for 12 months of postpartum care.
