Note that Children’s Health Insurance Program (CHIP) and Prenatal Care are not available to undocumented children and pregnant women. Undocumented pregnant women may be eligible for Emergency Medical Assistance (EMA) to cover labor and delivery (and during pregnancy, if they have an emergency medical condition).

Emergency Medical Care

Hospitals must provide emergency treatment under the Emergency Medical Treatment and Labor Act (EMTALA), and TennCare offers reimbursement for specific emergency services for non-citizens that meets the following requirements:

  • Would be eligible under an existing TennCare eligibility category but for his or her immigration status

  • Have an Emergency Medical service period on the date on which he or she received emergency services

  • Received emergency services that meet the federal standards.
